The Nevada homestead lives in Chapter 115 of the state statutes, and the form is filed with the county recorder. It protects a home's equity and does not change the property tax bill. ## What the statute says NRS 115.010 provides that a homestead is not subject to forced sale on execution or any final process from a court, with listed exceptions. The exemption extends only to the amount of equity that does not exceed a dollar cap set in the statute, which currently reads 605,000 dollars of equity, unless allodial title has been established and not relinquished. This is a creditor protection and not a tax figure, and the legislature can change the cap, so read the statute for the current number. The statute defines a homestead as land with the dwelling and its appurtenances, a mobile home, or a unit in a common-interest community with its share of the common elements. Equity means the fair market value of the property minus liens that the exemption does not cover. ## What it does not cover The exemption does not extend to debts that secure the property. NRS 115.010 lists obligations contracted to buy the property or improve it, mechanics liens, legal taxes, any mortgage or deed of trust, including second mortgages, refinances, lines of credit and home equity loans, and certain liens in favor of an owners association. NRS 115.090 separately excludes money owed to the state's Medicaid agency. ## Recording a declaration NRS 115.020 describes the declaration of homestead, which must be recorded, and sets notice requirements for anyone who charges a fee to record a declaration for you. The Washoe County Recorder's office publishes a Homestead form and an Abandonment of Homestead form on its Forms page, so you can record it yourself with the county. Because the declaration touches a legal right, many owners ask an attorney or a title company to review the wording first. ## A different question: property tax relief If you are asking about lower property tax bills, the relevant tools are the abatement cap on owner-occupied homes and the Assessor's exemptions for veterans, disabled veterans, surviving spouses and blind persons. Owners who have recorded a homestead on a previous Nevada home should ask whether that declaration needs to be abandoned and a new one recorded. NRS 115.055 deals with sale proceeds, which are only exempt if reinvested in another identified property within the periods the statute sets.
