Privacy Policy

Last updated

This Privacy Policy explains how O'Brien's Moving & Storage, Inc. ("O'Brien's," "we," "us" or "our") collects, uses, discloses, retains and protects information about you when you visit obriensmoving-storage.com, send us an estimate request or a message through a form, use our planning tools, chat with our website assistant Clover or otherwise interact with the Site. It is written to meet Chapter 603A of the Nevada Revised Statutes (NRS). Please read it carefully. By using the Site you acknowledge the practices described here.

1. Who we are and what this Policy covers

The Site is operated by O'Brien's Moving & Storage, Inc., a family-owned moving and storage company located at 2277 Glendale Ave, Sparks, NV 89431, in business since 1941.

We move households and businesses locally in Northern Nevada and the Lake Tahoe area, move customers long distance as an interstate agent for Bekins Van Lines, store household and commercial goods in our Sparks warehouse, and provide packing, crating, specialty-item moving and furniture receiving, delivery and installation.

This Policy covers information collected through the Site, including its forms, planning tools and chat assistant. Information you give us when we survey your home, prepare an estimate, move or store your goods is described in Section 5.

The purpose of the Site is to provide information about our services, our licenses and the moving process, and to let you ask for a free in-home estimate.

2. Definitions

In this Policy, the following terms have the meanings below. Other capitalized or quoted terms have the meanings given where they first appear.

  • "Site" means obriensmoving-storage.com, including the plain-text versions of its pages, its llms.txt summary files and any other page that links to this Policy.
  • "Personal information" means information that identifies, relates to or can reasonably be linked to a particular individual or household, such as a name, telephone number, email address or the content of a message. It includes "covered information" as defined in NRS 603A.320 to the extent that definition applies.
  • "Request" means a Check-my-date form or contact form submission, a before-you-go panel submission, a chat conversation in which you provide your contact details, or an email through which you ask us for information or ask us to contact you.
  • "Service provider" means a company that processes personal information on our behalf to help us operate the Site and our business, and that is not permitted to use it for its own unrelated purposes.
  • "Browser storage" means small pieces of information that the Site saves in your web browser using the browser's local storage or session storage features. It is similar in purpose to a cookie but is not sent to our servers with every page request.
  • "Cookie" means a small text file placed in your browser by a website or by a third-party service loaded on a website.

3. Summary of our practices

This summary highlights the key points of this Policy. It is not a substitute for the full Policy, which controls.

  • We collect the information you choose to give us when you ask about a date or send a message, plus limited technical information from your browser.
  • Analytics and advertising measurement tools load by default when you use the Site. Our privacy choices card tells you this on your first visit and lets you turn them off at any time by choosing "Essential only." If your browser sends a Global Privacy Control signal, the Site treats it as "Essential only" automatically.
  • We do not sell personal information. We do not share it with other companies for their own marketing.
  • Nevada residents may direct us not to sell their covered information and may ask to review or correct it. Residents of other states may have additional rights under their state laws, to the extent those laws apply to us.

4. Information you provide through the Site

The forms on the Site ask for your name and a telephone number or email address, and allow you to add where you are moving from and to, a move date, the type and size of your move, how you prefer to receive your estimate and a note. The business project form also asks for your company, your role, the project type, the site, dates and size.

Our planning tools (the Load Planner, packing calculator, vault sizer, checklist generator, inventory builder and route lookup) work in your browser. What you enter stays in your browser unless you choose to send it to us with a form, in which case the summary is included with your request.

When you use our chat assistant, Clover, we receive the content of the conversation, including anything you type. Please do not enter payment card numbers, government identification numbers or other sensitive information in a form or in the chat.

If you give us information about another person, such as a family member who is moving with you or a contact at your business, please make sure you have their permission.

5. Information for your move and information collected automatically

If we survey your home, prepare an estimate, move or store your goods, we collect the information reasonably needed to do that work and document it, such as names, addresses at origin and destination, contact details, an inventory of your goods and their condition, weights, dates, valuation choices and payment records. Interstate moves are also documented as federal rules require, including the estimate, order for service, bill of lading and inventory.

On an interstate move booked through the Bekins Van Lines network, the information needed to perform and document the move is shared with Bekins Van Lines and the agents and drivers who carry or deliver your shipment.

This information is collected in person, by telephone or in writing, not through the Site, and is handled in the ordinary course of our business and as the law requires.

When you visit the Site, some information is collected automatically, as described in Sections 8 to 10.

6. Our website chat assistant (Clover)

Clover is an automated chat assistant on the Site, powered by YelloPost AI, an artificial-intelligence service provided to us by our website partner, YelloPost.

Clover is not a person. It answers general questions from information we provide, and it can make mistakes. It does not give prices, and it cannot book a move, hold a date or make any promise on our behalf.

The messages you type, and Clover's replies, are processed by YelloPost AI and its technology providers to generate the replies, and a copy of the conversation may be kept to monitor quality and prevent abuse.

If you give Clover your name and a telephone number or email address, a summary of your request is emailed to our office so we can call you back.

7. Automated screening, spam and duplicate protection

Screening. To protect our team and our customers, requests submitted through the Site are automatically screened for spam, abuse, duplicate submissions and unsolicited sales solicitations. Screening is performed by automated rules and tools operated for us by our website provider. A message that the screening flags may be held for review by a person before it is delivered or acted on. A second copy of the same request sent within a few minutes may be treated as a duplicate and not delivered twice. Screening is used only to decide how a message is handled. It is not used to make decisions that produce legal or similarly significant effects about you.

If your request is held. If you sent a genuine request and have not heard from us, please call us at 775-359-6683.

Cloudflare Turnstile. Our forms use Cloudflare Turnstile, a human-verification check that usually runs invisibly in the background and loads when you start to fill in a form. To determine whether a submission is coming from a person or an automated program, Turnstile processes information about your browser and device and your interaction with the page, and Cloudflare receives your IP address. Cloudflare also provides domain name (DNS) and security services for the Site. Cloudflare processes this information under its own privacy policy.

8. Browser storage and cookies we use

The Site itself does not use browser storage to track you across other websites. It uses browser storage for the following limited purposes, which are necessary for the Site to work as you expect or to remember choices you have made:

  • Local storage: your privacy choice ("Accept all" or "Essential only"), so that the privacy choices card does not reappear on every page.
  • Local storage: your accessibility menu settings, such as text size or contrast, if you use the accessibility menu.
  • Local storage: whether you closed the chat button or the accessibility button, so that it stays closed.
  • Local storage: the boxes you ticked on a checklist page, such as the what-to-bring list, so that they are still ticked when you come back.
  • Session storage: whether you have already sent a request during your current visit, so that we do not show you the before-you-go panel after you have contacted us, and whether that panel has already been shown. Session storage is cleared when you close the browser tab.

Information in local storage stays in your browser until you clear it. You can clear browser storage and cookies at any time through your browser settings. If you do, the Site will treat you as a new visitor, show the privacy choices card again and forget your accessibility settings.

Cookies placed by analytics and advertising measurement tools are placed by default unless you choose "Essential only" or your browser sends a Global Privacy Control signal. They are described in Section 9.

9. Analytics, advertising measurement and your choices

The privacy choices card. When you first use the Site, a card tells you that analytics tools are used and offers two choices: "Accept all" and "Essential only." You can change your choice at any time by selecting the "Privacy choices" link in the footer of any page, which reopens the card.

Essential only. If you choose "Essential only," the Site does not load Google Tag Manager, Google Analytics or Google Ads conversion measurement, and if they were already loaded the page reloads without them. Your browser remembers this choice using the browser storage described in Section 8, so these tools stay off on later pages and visits unless you change your choice. The Site continues to work, including the forms and the chat assistant.

Global Privacy Control. If your browser sends a Global Privacy Control signal, the Site treats it the same as "Essential only" and does not load these tools, whatever choice is stored.

Accept all. By default, and if you choose "Accept all" or simply continue using the Site without making a choice, the Site loads Google Tag Manager after the page has finished loading or after your first interaction with the page. Through Google Tag Manager, the Site may load Google Analytics 4, which helps us understand how visitors use the Site, and Google Ads conversion measurement, which helps us understand whether our Google advertising leads to requests and calls. These tools set cookies and collect information about your visit and actions on the Site, which Google processes. Google may combine that information with other information it holds about you, such as information associated with your Google account, according to Google's own policies and your Google settings.

Tracking over time and across websites. Unless you choose "Essential only" or send a Global Privacy Control signal, Google may collect information about your online activities over time and across different websites, including the Site.

Google's controls. You can learn about Google's practices and choices at policies.google.com, and you can control ad personalization through your Google account settings. Google also offers a browser add-on for opting out of Google Analytics.

Browser-level controls. Most browsers let you block or delete cookies and browser storage, and some offer built-in tracking protection. Blocking all storage may cause parts of the Site, such as remembering your privacy choice, to stop working.

10. Third-party resources that receive your IP address

Some content on the Site is loaded from third-party servers. When your browser requests that content, the third party receives your IP address and standard technical information from your browser, and it processes that information under its own privacy policy. These resources are:

  • Cloudflare, which provides DNS and security services for our domain and runs the Turnstile check on our forms.
  • Google Maps, which provides the map on our location, contact and home pages. The map loads only when you tap Show the map. Our address and directions are also on the Site as text.
  • Fonts are not a third-party resource: the Site's typefaces (Source Serif 4 and Open Sans, under the SIL Open Font License) are served from our own server, so no font provider receives your IP address.
  • Google Tag Manager, Google Analytics 4 and Google Ads conversion measurement, which load by default unless you choose "Essential only" or send a Global Privacy Control signal.

Those websites receive information from your browser only if you click a link and visit them. See Section 24.

11. How we use personal information

We use personal information for the following purposes:

To survey your home, prepare your estimate, plan, perform and document your move or storage, and send the paperwork federal and Nevada rules require.

  • Responding to requests. To answer your questions, call or email you back, and confirm whether the date and time you asked about can be arranged.
  • Confirmations and service communications. To send you an automatic confirmation of your request if you gave us an email address, and to communicate with you about your move and your estimate.
  • Quality and delivery monitoring. To confirm that requests from the Site reach our team, and that our forms and chat work properly.
  • Measurement and improvement. To understand which pages and advertisements lead people to contact us, and to improve the Site, our content, our advertising and our customer service.
  • Security and abuse prevention. To protect the Site, our forms, our chat assistant, our team and our customers against spam, fraud, unsolicited solicitation and other abuse.
  • Legal and business purposes. To keep business, tax and accounting records, comply with legal obligations, respond to lawful requests, establish or defend legal claims, enforce our Terms of Use, and in connection with a business transfer described in Section 12.

We do not use personal information for purposes that are materially different from those described above without telling you and, where required by law, asking for your consent.

12. How we share personal information

We do not sell personal information, and we do not share it with other companies for their own marketing. We share personal information only as described below.

Service providers. We share personal information with service providers that perform services for us and are expected to keep it confidential and use it only to provide their services to us. They include:

  • Our website provider, YelloPost, which builds and hosts the Site, operates our forms and the screening described in Section 7, and receives copies of request notifications and chat conversations so that it can monitor delivery and quality.
  • YelloPost AI, the artificial-intelligence service that powers our chat assistant, and its technology providers.
  • Email delivery services that send request notifications to our team and confirmation emails to you.
  • Cloudflare, which provides DNS, security and the Turnstile check.
  • Google, unless you choose "Essential only" or send a Global Privacy Control signal, for analytics and advertising measurement as described in Section 9.

Government offices.

Legal and compliance. We may disclose information when we believe in good faith that disclosure is required by law, regulation, subpoena, court order or other legal process; to respond to lawful requests from government authorities; to establish, exercise or defend legal claims; to enforce our agreements; or to protect the rights, property or safety of our customers, our team, the public or us.

Business transfers. If we are involved in a merger, acquisition, financing, reorganization, sale of all or part of our business or assets, or a similar transaction, personal information may be disclosed to the parties involved and transferred as part of the transaction, subject to this Policy or to a notice we provide.

With your direction or consent. We may share information with anyone else when you ask us to or give us permission.

Aggregated or de-identified information.

13. Sale of personal information and targeted advertising

We do not sell personal information for money. We do not sell "covered information" as that term is defined in NRS 603A.333.

Unless you choose "Essential only" or send a Global Privacy Control signal, Google Ads conversion measurement may allow Google to associate your visit and actions on the Site with our advertising and with information Google holds. Under some state laws, this kind of measurement may be treated as "sharing" for cross-context behavioral advertising or as "targeted advertising." We describe it here so that you can decide. You can turn it off at any time by choosing "Essential only" through the "Privacy choices" link in the footer. We treat the "Essential only" choice and a Global Privacy Control signal as your opt-out of this measurement. Apart from Google Ads conversion measurement when it is loaded, we do not share personal information for cross-context behavioral advertising.

14. Emails the Site sends

Notifications to our team. Every request submitted through the Site generates an email to our team containing the information you provided. Chat conversations in which you give your name and a telephone number or email address also generate an email to our team.

Copies to our website provider. Our website provider, YelloPost, receives copies of request notifications and chat conversations so that it can monitor whether requests are delivered and handled and whether the forms and chat are working properly.

Confirmation to you. If you include an email address in your request, you will receive an automatic confirmation email. It confirms that we received your request; it does not confirm or hold a date. If you reply to it, your reply comes to us.

No marketing lists. We do not add you to a marketing email list because you sent a request. If we ever send marketing email, it will include a way to unsubscribe.

15. How long we keep personal information

We do not keep personal information for a fixed period in every case. Instead, we keep it for as long as reasonably needed for the purposes described in this Policy, and then delete it or de-identify it when it is no longer needed. In deciding how long to keep information, we consider:

  • Tax, accounting, recordkeeping and other legal requirements.
  • Whether the information is relevant to an actual or potential dispute, claim, investigation or legal proceeding.
  • The need to protect against spam, fraud and abuse.
  • Whether you have asked us to delete the information and whether we are permitted or required to keep it.

Chat conversations are kept with the record of the request they relate to and are handled under the same criteria. Information in your browser storage stays in your browser until you clear it. Information collected by Google, when those tools are loaded, is kept according to Google's retention settings and policies.Backup copies may persist for a limited time after deletion from active systems until they are overwritten in the normal course.

16. How we protect personal information

We use reasonable administrative, technical and physical safeguards designed to protect personal information against loss, misuse and unauthorized access, disclosure, alteration and destruction. These safeguards include:

  • Encrypted connections (HTTPS) between your browser and the Site.
  • Access controls on the systems that hold personal information.
  • Limiting access to people who need the information to do their jobs.
  • Requiring our service providers to keep personal information confidential.
  • Automated screening and human verification on our forms, and limits on the chat.

No method of transmitting information over the internet, and no method of electronic storage, is completely secure. We cannot guarantee absolute security. Email in particular is not always encrypted in transit. Please keep this in mind when deciding what to send us, and contact us by telephone if you prefer.

17. Security incidents and breach notification

If we learn of a breach of the security of a system that holds personal information about Nevada residents, we will provide notice as required by NRS 603A.220, in the most expedient time possible and without unreasonable delay, consistent with the legitimate needs of law enforcement and any measures necessary to determine the scope of the breach and restore the reasonable integrity of the system. For residents of other states, we will provide notice as required by the laws that apply. If you believe your information has been compromised through our Site or our communications, please contact us right away.

18. Nevada privacy notice (NRS 603A.300 to 603A.360)

This section, together with the rest of this Policy, is our notice under NRS 603A.340 to consumers who use the Site. It addresses each element required by that law.

Categories of covered information we collect. Through the Site and our online services, we collect the following categories of covered information about consumers who use or visit the Site:

  • First and last name.
  • Telephone number.
  • Email address, if you provide one.

Categories of third parties with whom we may share covered information. We may share covered information with the categories of third parties described in Section 12: our service providers (website and hosting, email delivery, the chat assistant service, security and human verification, and, unless you choose "Essential only" or send a Global Privacy Control signal, analytics and advertising measurement); government offices and courts for legal and compliance purposes; and parties to a business transfer.

Reviewing and requesting changes. You may review and request changes to the covered information we have collected about you through the Site by contacting us at agent0143@obriensmoving.com, by calling 775-359-6683 or by writing to us at the address in Section 28. Section 21 explains how we handle these requests.

How we notify you of material changes. We will notify you of material changes to this Policy by posting the updated Policy on this page with a new effective date, and, for material changes, by providing additional notice on the Site, such as a notice near the top of this page or in the Site footer, for a reasonable period.

Collection over time and across websites. Third parties may collect covered information about your online activities over time and across different websites when you use the Site, because Google Tag Manager and the Google tools described in Section 9 load by default. If you choose "Essential only" or send a Global Privacy Control signal, those tools are not loaded. See also Section 10 and Section 23.

Effective date. This Policy is effective as of the date shown at the top of this page.

19. Your Nevada right to opt out of the sale of covered information (NRS 603A.345)

Your right. Nevada law gives consumers the right to direct an operator not to make any sale of covered information that the operator has collected or will collect about the consumer. We do not sell covered information as defined in NRS 603A.333. Even so, you may submit a verified request directing us not to sell your covered information in the future, and we will honor it.

How to submit a request. Email your request to our designated address, agent0143@obriensmoving.com, with the subject line "Nevada Do Not Sell Request." Please include your name and the telephone number or email address you used when you contacted us, so that we can locate your information and verify your request. You may also call 775-359-6683 and we will help you submit the request.

Our response. We will respond to a verified request within 60 days after we receive it. If reasonably necessary, we may extend that period by up to 30 additional days, and we will let you know if we do.

20. Consumer health data

Nevada law (NRS Chapter 603A, as amended by Senate Bill 370 of 2023) provides protections for "consumer health data." Our Site asks about moves, storage and business projects, not about anyone's health, and we do not seek consumer health data through the Site. Please do not send us health information through a form or the chat.

21. How to make a privacy request

What you can ask. You may ask us to tell you what personal information we hold about you, to give you a copy of it, to correct information that is inaccurate, to delete it, or to stop contacting you by a particular method. Nevada residents may also make the requests described in Sections 18 and 19.

How to ask. Email agent0143@obriensmoving.com, call 775-359-6683, or write to us at the address in Section 28. Please describe your request and tell us how we can reach you.

Verification. To protect your information, we will take reasonable steps to verify your identity before acting on a request, which usually means confirming information you gave us when you contacted us, such as your name, telephone number or email address. We will use the information you provide in a request only to verify and respond to it.

Authorized agents. You may use an authorized agent to make a request on your behalf where the law allows. We may ask the agent for proof of authorization and may ask you to verify your identity directly.

Limits. We will explain the reason if we cannot fulfill all or part of a request.

Timing. We aim to respond to requests promptly and within the time required by applicable law.

No retaliation. We will not deny you service, charge you a different price or provide a different level of service because you exercised a privacy right.

22. Residents of other states and other countries

We are a local business in Sparks, Nevada, and we move customers to and from other states.

Some of those laws apply only to businesses that meet certain thresholds, for example based on annual revenue or the number of residents whose information is processed, and may not apply to a business of our size. To the extent a state privacy law applies to us and to your information, we will honor requests made under it. Whether or not a particular law applies, you may contact us with any privacy request using the methods in Section 21 and we will consider it in good faith.

California residents. If the California Consumer Privacy Act applies to our handling of your information, the categories of personal information we collect, the sources, the purposes and the categories of recipients are described in Sections 4 through 14 of this Policy. We do not sell personal information and do not knowingly sell or share the personal information of consumers under 16 years of age. You may exercise any applicable rights using the methods in Section 21.

23. Do Not Track and Global Privacy Control

Do Not Track. Some browsers can send a "Do Not Track" signal. Because there is no common industry standard for how to respond to these signals, the Site does not respond to them.

Global Privacy Control. The Site reads the Global Privacy Control signal. When your browser sends it, the Site does not load Google Tag Manager, Google Analytics or Google Ads conversion measurement, the same as if you had chosen "Essential only." You can also choose "Essential only" yourself at any time through the "Privacy choices" link in the footer.

24. Children, links, reviews and social media

Children and minors. The Site is intended for adults and is not directed to children. We do not knowingly collect personal information from children under 13 years of age, consistent with the Children's Online Privacy Protection Act. If you are a parent or guardian and believe your child under 13 has provided personal information through the Site, contact us and we will delete it. Individuals under 18 should not send requests or chat with our assistant.

Links. When you follow a link, the third party's own privacy policy governs what it collects. We are not responsible for the privacy practices of websites we do not operate, and we encourage you to read their policies.

Reviews. The Site shows reviews that customers posted publicly on Google, with the reviewer's first name and last initial. If you post a review on a review platform, what you post is public and is governed by that platform's terms. If you would like a review of yours removed from our Site, contact us and we will remove it.

25. Your contact preferences

When you send a request, you ask us to contact you about it.You can tell us at any time to stop contacting you by a particular method, and we do not send marketing text messages.

26. Where your information is processed

We are located in Nevada and our service providers process information in the United States. If you use the Site from outside the United States, your information will be transferred to and processed in the United States.

27. Changes to this Policy

We may update this Policy from time to time to reflect changes in the Site, our services, our service providers or the law. When we do, we will post the updated Policy on this page and change the effective date at the top. If we make material changes, we will provide additional notice on the Site as described in Section 18. Changes take effect when posted, unless the notice says otherwise. We encourage you to review this Policy periodically. Your continued use of the Site after a change takes effect means that the updated Policy applies to your use. Changes will not apply retroactively to information in a way that is materially less protective without your consent where the law requires it.
